Under the Migration Regulations 1994, a person is considered a member of the family unit of the “Family Head” if they meet one of the following criteria:
ย
– ๐๐ฉ๐จ๐ฎ๐ฌ๐ ๐จ๐ซ ๐๐ ๐
๐๐๐ญ๐จ ๐๐๐ซ๐ญ๐ง๐๐ซ: The legal spouse or de facto partner of the family head.
– ๐๐ก๐ข๐ฅ๐๐ซ๐๐ง ๐จ๐ซ ๐๐ญ๐๐ฉ-๐๐ก๐ข๐ฅ๐๐ซ๐๐ง: A child or step-child of the family head (or of their partner) who is not married or in a de facto relationship, and:
ย ย ย – Is under ๐๐ ๐ฒ๐๐๐ซ๐ฌ of age; OR
ย ย ย – Is between ๐๐ ๐๐ง๐ ๐๐ ๐ฒ๐๐๐ซ๐ฌ old and is financially dependent on the family head or partner; OR
ย ย ย – Is ๐๐ ๐ฒ๐๐๐ซ๐ฌ ๐จ๐ซ ๐จ๐ฅ๐๐๐ซ and meets specific dependency criteria under paragraph 1.05A(1)(b).
– ๐๐๐ฉ๐๐ง๐๐๐ง๐ญ ๐๐ก๐ข๐ฅ๐๐ซ๐๐ง: Any dependent child of a person who meets the conditions listed above.

The relationship between a stepchild and a stepparent is legally defined and depends on the marriage between the biological parent and the stepparent.

– ๐๐๐ฅ๐๐ญ๐ข๐จ๐ง๐ฌ๐ก๐ข๐ฉ ๐๐๐ฉ๐๐ง๐๐๐ง๐๐ฒ: A step-relationship is generally bound by the marriage. If the marriage ends, the step-relationship ends unless the stepparent has a guardianship/parenting order or custody rights (for children under 18).
– ๐๐ฉ๐จ๐ง๐ฌ๐จ๐ซ๐ฌ๐ก๐ข๐ฉ (๐.๐ ., ๐๐๐๐๐ ๐๐ข๐ฌ๐): Yes, a stepchild can sponsor a visa where the biological parent is a secondary applicant and the stepparent is the primary applicant.
– ๐๐๐ฒ ๐๐๐ช๐ฎ๐ข๐ซ๐๐ฆ๐๐ง๐ญ: The spousal relationship between the biological parent and the stepparent must be clearly evidenced. Under Reg 1.14A, references to a “parent” in migration law include step-parents.

New English language test score requirements will take effect on ๐๐ฎ๐ ๐ฎ๐ฌ๐ญ ๐, ๐๐๐๐. Here is how the transition works:

๐๐๐ ๐๐ฎ๐ ๐ฎ๐ฌ๐ญ ๐, ๐๐๐๐: If your test was conducted before this date, the old score requirements apply. There is a ๐-๐ฒ๐๐๐ซ ๐ ๐ซ๐๐๐ ๐ฉ๐๐ซ๐ข๐จ๐ for these results, regardless of whether your application is lodged before or after the cut-off date.
– ๐๐๐ฌ๐ญ๐ฌ ๐๐๐ค๐๐ง ๐๐ ๐จ๐ซ ๐๐
๐๐๐ ๐๐ฎ๐ ๐ฎ๐ฌ๐ญ ๐, ๐๐๐๐: If your test is conducted on or after this date, you must meet the new (updated) score requirements specified in the new instrument.
– ๐๐ญ๐ฎ๐๐๐ง๐ญ ๐๐ข๐ฌ๐๐ฌ ๐๐ฑ๐๐๐ฉ๐ญ๐ข๐จ๐ง: Under LIN 24/022, it appears that the old scores may continue to apply for student visas for the next ๐ ๐ฒ๐๐๐ซ๐ฌ.
– ๐๐ฎ๐๐๐ฅ๐๐ฌ๐ฌ ๐๐๐: Note that the 482 visa category has a different regulation (LIN 24/045) regarding these requirements.
